Ct. 1525 (2020) The United States Supreme Court granted cert to review a Second Amendment case for the first time in ten years. But a postcert change to the challenged rule swung the Court’s attention to mootness in New York State Rifle and Pistol Association versus City of New York. Under a New York City rule, city residents with a premises license to keep a handgun in their home were generally prohibited from removing that handgun from the address listed on their license. There was one exception, which said that it was okay to take your premises licensed handgun to any of the seven authorized shooting ranges inside city limits. The New York State Rifle and Pistol Association, together with several other plaintiffs, filed a Second Amendment lawsuit in the Southern District of New York. The association asked for injunctive relief against the rule to the extent that it prohibited city residents from taking their premises licensed handguns to second homes or shooting ranges outside city limits. The district court denied relief, and the Second Circuit affirmed on appeal. The association appealed to the United States Supreme Court, which granted cert. After the Court granted cert but before it decided the case, the city changed the rule so that premises licensed handguns could be taken to second homes and shooting ranges outside city limits. Then the association pivoted, asking for damages with respect to the original rule and arguing that the changed rule might also violate the Second Amendment by preventing routine stops for things like coffee, food, and gasoline. The city countered that it was too late to ask for damages and that the changed rule would allow for routine stops. Want more details on this case?
