United States | 341 U.S. 494 (1951) During the 1900s, proponents of the ideology of Marx and Lenin advocated for worldwide revolutions to overthrow capitalist democracies. By the end of World War II, many people in the United States subscribed to these views and some even advocated for the overthrow of the United States government. Did the First Amendment protect their advocacy? The United States Supreme Court addressed this issue in Dennis versus United States. In the late 1940s, as the Iron Curtain was falling, Eugene Dennis and several other men established the Communist Party in America. The men formed secret schools to teach the Marxist-Leninist ideology and advocated for the overthrow of the United States government through revolution. A federal grand jury charged Dennis and his fellow leaders with violating the Smith Act. That act prohibited conspiring with others to advocate for overthrowing the government by force or violence. The defendants moved to dismiss the indictment under the First Amendment. The district court denied their motion. Dennis and his codefendants were convicted at a jury trial. On appeal, the United States Court of Appeals for the Second Circuit affirmed their convictions. Dennis and the others successfully petitioned the United States Supreme Court to review their cases.
