Farmers’ Loan and Trust | 157 U.S. 429 (1895) Paying taxes isn’t an enjoyable experience for most citizens. For good or bad, what taxes the federal government may impose has changed over time. In Polloc k versus Farmers’ Loan and Trust, we’ll explore some of the requirements the federal government must meet when imposing taxes. In eighteen ninety-four, Congress imposed a two percent tax on all income earned by United States citizens, including income derived from real estate and personal property. To comply with this tax, the directors of Farmers’ Loan and Trust announced to its shareholders that the trust would pay the tax to the United States on their behalf. One of the shareholders, Pollock, argued that the tax was unconstitutional because it improperly taxed property in a way that violated apportionment rules and was therefore void. Pollock filed suit in the United States District Court for the Southern District of New York to prevent the trust from complying with the tax, arguing that the directors would breach their duty of trust if they paid an unconstitutional tax. The district court denied the injunction. Pollock appealed to the United States Supreme Court. Want more details on this case?
