I used to think of it as building America one case at a time. My name is Paul Wickham Schmidt and I served as a United States immigration judge from 2003 to my retirement in June 2016. An asylum case's judge isn't supposed to be looking for ways to say no. It's supposed to be looking to see if these people can be protected. I'd say that almost everybody that came before me in court ... they all were making contributions, they were working hard, they were raising their families. The first thing you usually have to decide is whether the testimony is credible or not. Then you decide whether that fact situation fits within any of the categories of people that can stay. It's a human decision, that's what refugee law is really supposed to be. That obviously is a difficult time when you have to tell somebody that they're going to have to return even though you probably believe that they're going to be in trouble when they go back. There's no doubt about the fact that I've made mistakes and I probably have sent some people home that I should have allowed to stay and I've probably allowed some people to stay that maybe weren't telling me the whole truth, but I couldn't figure it out. I like swearing in. It was one of the fun parts of the job. Most immigrants here are law abiding individuals who just want pretty much the same things we all do: a stable place to live, a future for their children and a chance to use their skills in an environment where they're not in fear all the time. Immigrants have built this country, made huge contributions. Pounding drywall, building houses, fixing bridges, fixing cars, helping hotels, taking care of children. You know, the things that really make America, America. |
