United States | 481 U.S. 412, 107 S.Ct. 1831 (1987) The Seventh Amendment to the United States Constitution guarantees the right to a jury trial in certain federal civil cases. In Tull versus United States, we’ll see whether a person had a right to a jury trial to determine his or her liability for violating the Clean Water Act. The Clean Water Act prohibits a party from discharging dredged or fill material into navigable waters, including wetlands, unless the party has a National Pollutant Discharge Elimination System permit. Edward Tull, a real estate developer, dumped fill material at three different wetland locations without a permit. The United States government sued Tull for violating the Clean Water Act. Under the Clean Water Act, violators can be subject to an injunction and or a civil penalty of up to $10,000 per day during the violation. The government sought both injunctive relief and civil penalties against Tull. However, by the time the government filed its complaint, the properties had been sold to new owners, so injunctive relief was impractical. The government sought the maximum civil penalty against Tull, which was over twenty-two million dollars. Tull demanded a jury trial. The district court denied Tull’s demand. After a bench trial, the district court found Tull guilty of violating the Clean Water Act by filling the wetlands on his properties without a permit. Tull appealed. The court of appeals affirmed the district court’s holding and rejected Tull’s argument that he was entitled to a jury trial under the Seventh Amendment. The United States Supreme Court granted cert.
