Did you receive a phone call from a detective? Did he ask you to answer some questions? Do you have to answer his questions over the phone? What if he wants you to meet up with him and do a formal interview? How do you know if you are being investigated? What should you do? Should you meet with him? What if you are innocent? Can you explain your innocence and avoid arrest? Let's examine the 5 steps you must take to avoid criminal charges during an investigation:
Rule # 1 – Do Not Talk To The Detective About Anything Over The Phone Or In Person
Politely tell the officer you would be happy to answer his questions with your lawyer present and you will be having your criminal attorney call him to set up a time that will work for everyone. Why is this important? Everything you say to a police officer over the phone will be used against you. Especially if you are innocent – resist the temptation to “clear your name.” Ideally, the detective would hear your side of the story and fairly investigate the charge to clear your name. After all, you are supposed to be presumed innocent until proven guilty, right? Unfortunately, it doesn't work that way. The detective is interested in interrogating you and writing down anything you say to fit the story he already believes.
Rule #2 – Don’t Believe That The Detective Only Wants To Hear Your Side Of The Story
Remember, the detectives are trained to act like they want your side of the story. In reality, they are gathering information to label it as evidence and establish probable cause to get an arrest warrant from a judge. Don't forget, you have a 6th Amendment right to hire a criminal attorney and a 5th Amendment right to remain silent and not answer the detectives questions. If you start talking to the detective and tell your side of the story, you are failing to exercise your Constitutional rights. This makes you vulnerable and an easy target for the police!
Rule #3 – Be Careful Talking About Any Of The Facts To Anyone Else During A Criminal Investigation
What happens if an incident did occur where you were present but you did nothing wrong? Maybe you start talking people that were at the scene and telling them information you know and trying to do what you can to clear your name with them. Are you at risk by talking to witnesses and other people? Yes!
Detectives interview witnesses as part of their criminal investigation and they will be asking those people present at the crime scene questions about you. If you are talking to everyone, you make yourself an easy target for the actual criminal to claim you did it! Here is the real problem - a witness could claim you told them something and they may have misinterpreted you or chose to manipulate what you said and explained it to the officer in a way to make you look guilty. This is dangerous because if you are the suspect, these statements by others can be used against you to obtain an arrest warrant and potentially convict you of a crime you did not commit!
Rule #4 – Filter All Communication Through An Experienced Criminal Defense Attorney
Why? Because everything you say can be used against you and interpreted as incriminating against you. By working with an experienced and aggressive criminal defense attorney, everything your attorney says is hearsay and cannot be used against you.
Rule #5 – Don’t Panic! Don’t Run!
Running from a criminal investigation only makes you look guilty! It almost guarantees that the detective will obtain a warrant for your arrest and your running may be used in his report to make it appear as a sign of guilt in court. Don't Run! Fight your criminal investigation the right way and follow these 5 steps to protect you from a criminal investigation.
