| Video Discription | LOWER TDS OR NIL TDS || TDS on NRI Property || Concept of Lower Deduction of Tax || Every person means Individual, HUF, AOP, BOI, Trust claiming benefit of section 11 or section 12 or section 10 of the Income Tax Act, society, company, firm etc. is eligible to apply for Form 13, however benefit of lower/Non deduction of taxes will be allowed only when the Assessing officer is satisfied that the income of the assesse is justified for lower/ Non deduction of taxes or where deduction or collection of taxes at higher rate would create an undue hardship against the assesse. According to section 194IA, the tax must be deducted at 20% plus applicable cess (4%) & surcharge (10 or 15%) from the total sale consideration if the seller is a non-resident Indian (NRI). TDS ontransaction of transfer of immovable property by Non-Resident to Resident was covered by Sec 195. Therefore, even if the value of the property is less than INR 50 lakhs, the buyer must deduct the tax in the case of an NRI.
