Citizens Against State Torture (CAST), a UK-based campaigning group concerned with the breakdown of civil society and rights in Pakistan submitted an urgent petition to the UN Special Rapporteur on the Promotion and Protection of Freedom of Opinion and Expression on Monday 5 February 2024, just days before a highly controversial election is scheduled to take place in Pakistan.
The petition calls on the UN expert to initiate an urgent investigation into the widespread and systematic suppression of political freedoms in Pakistan.
Just days before elections are due in Pakistan former Prime Minister Imran Khan was sentenced to 10 years' imprisonment for allegedly leaking state secrets and 14 years for corruption following highly controversial criminal proceedings. Khan denies the allegations and claims them to be political in nature, designed to suppress his free participation in elections.
The sentencing follows months of political unrest and allegations of serious violations of international law and suppression of political freedoms in the country.
The petition submitted to the UN expert was commissioned by Dr Usman Khan, a founder of CAST and the cousin of former Pakistani Prime Minister Imran Khan. CAST was established to work to promote Pakistani citizens’ civil and political rights following the removal of Imran Khan from government.
The NGO raises complaints about the treatment of former Pakistani Prime Minister Imran Khan and breach of his individual rights including a ban on media reporting on Mr Khan by the Pakistani Electronic Media Regulatory Authority (PEMRA).
Imran Khan founded the Pakistan Tehreek-e-Insaaf political party (PTI) in 1996. The PTI grew to become one of the major Pakistani political parties. In 2018, PTI became the largest political party in the National Assembly and Mr Khan was elected the Prime Minister of Pakistan in a coalition arrangement. However, in 2022, Mr Khan was removed as Prime Minister following a no confidence vote and PTI lost control of the National Assembly.
CAST allege in their detailed petition that since Imran Khan’s removal there has been considerable political unrest in Pakistan which has translated into a widespread and systematic series of attacks on Pakistani civil and political rights. Commentators have described the situation as a “crackdown” on Mr Khan and the PTI. (1)
It is alleged, in the petition, that the actions of the political and military establishment have led to: the unlawful detention of Mr Imran Khan; politically based allegations of over 180 criminal charges; and the suppression of political activists through the arbitrary detention of thousands of PTI supporters and charges against them in military courts and under military law; and the arrests of PTI members and senior leaders.
Significantly, the petition notes with concern the ban on media reporting PEMRA as a clear indication of the targeting of Imran Khan.
CAST allege that the totality of these measures has created a chilling effect on supporters of Mr Khan and the PTI who have been practically restrained in their willingness and ability to express that support.
CAST allege that the elections, due to take place on 8 February, cannot be deemed to be considered in any way to be free and fair and note in their petition that: ‘Political expression, including the freedom to engage with the media, is a core civil and political right at the heart of the right to free and fair elections.
…the UN Special Rapporteur on Freedom of Expression recognised, the “free flow of ideas is incontestably a core requirement for the promotion of democratic spaces… [and] the full realisation of the right to access information, is another crucial element in the promotion of free and fair democratic elections". Limiting media access to and reporting on a political leader and entire political party is a direct attack on that free flow of ideas which, along with other restrictive measures, looks set to undermine the fairness of the Pakistan general election. That is a matter of grave concern which demands urgent action.’
CAST petitioned the UN Expert to urgently communicate a request for cooperation to the Government of Pakistan and specifically a request for an explanation of the media bans placed on Mr Khan and the targeting of PTI members and to call for the immediate cessation of all bans on Mr Khan and PTI members’ legitimate political speech.
