There could be actual possession of marijuana, where the marijuana is found on the person. So it would be in a pocket, or a purse, or a jacket, or simply in somebody's hand. Or there can be constructive possession of marijuana, and if the marijuana is not actually on the person but it's in a place where the person has access, then it would be constructively possessed. Or it could be jointly possessed. It can be possessed by more than one person at one time. So it could be, the marijuana could be owned by one individual, but possessed by multiple individuals provided that each of the individuals knew where the marijuana was and had access to it. Marijuana let's say is in the pocket of a driver. Even if the passenger of the vehicle knew the marijuana was there, they're not in possession of it. The reason being is that they don't have the right to go into the driver's pocket and take out that marijuana. So their rights, as far as the ability to be able to get the marijuana, that is determinative as whether they're actually in possession of it. |
