Thomas | 579 F.Supp.2d 1210 (2008) Capitol Records versus Thomas was one of the midpoints in the protracted copyright-infringement battle that resulted from record companies’ first efforts to put a stop to peer-to-peer file sharing. In the early aughts, single mother Jammie Thomas used the peer-to-peer file-sharing software Kazaa to download some music. She placed over seventeen hundred recordings in a shared folder from which others might access them. Capitol Records, concerned about the illegal file-sharing problem, had hired a firm called MediaSentry to search the Internet for illegally downloaded files. MediaSentry downloaded twenty-four files from Thomas’s folder but couldn’t prove that anyone else had downloaded music from her account. The Recording Industry Association of America sent Thomas a cease-and-desist letter. After Thomas and the Association failed to reach a settlement, Capitol Records and other recording companies sued Thomas in federal district court. They accused her of illegally downloading copyrighted recordings and distributing them on a peer-to-peer file-sharing application. At trial, the court instructed the jury that the act of copying recordings without permission violated the copyright owners’ exclusive right of distribution, regardless of whether the owners proved that distribution actually occurred. The jury found that Thomas had willfully infringed on Capitol’s recordings and awarded Capitol two hundred twenty-two thousand dollars in damages, over nine thousand dollars per song. Thomas requested a new trial on the issue of the constitutionality of the damages. The court sua sponte, or on its own initiative, raised the issue of whether the jury instruction was incorrect.
