The business establishment is not automatically liable just because you slipped on some water or other liquid substance. You must prove through evidence whether it's a surveillance video that the store has or through the testimony of witnesses that somehow that store, some employee, knew about the condition of the floor and didn't warn about it or correct it or should have known about the condition of the floor, meaning the condition of the substance on the floor by itself showed that it had been there for some period of time and that it was not corrected; it was not cleaned up. These sometimes are very difficult to prove. Many times these slip and fall law suits are dismissed by the judge because the plaintiff cannot prove evidence of what actually happened. Now, with more and more surveillance in stores it is easier to prove what happened. Many times, though, that surveillance can disprove the case as well as prove your case, so there is no inference that the store is responsible just because you slipped on something on the floor. You must affirmatively prove that the store was negligent. |
