| Video Discription | [2014] UKSC 8 | UKSC 2012/0198 Richardson and another (Appellants) v Director of Public Prosecutions (Respondent) On Appeal from the High Court (Queen's Bench Division) The issue in this appeal is whether the words "lawful activity" in s.68 Criminal Justice and Public Order Act 1994 ("the 1994 Act") are limited to acts/events which are 'integral' to the activities at the premises in question. The background is a protest held at Ahava, a shop in Covent Garden selling products from the Dead Sea. It is run by an English company, which is a subsidiary of an Israeli company operating out of an area the Appellants believe is not part of Israel, but an Israeli settlement in the occupied Palestinian Territory. As such, the Appellants maintain that Ahava's labelling of products as "made in Israel" breaches consumer protection legislation, and also accuses Ahava of offences of cheating the revenue, possessing and using criminal property, as well as aiding and abetting war crimes. The Supreme Court unanimously dismisses the appeal. An activity is 'unlawful' for the purposes of s.68 only if it involves a criminal offence integral to the core activity carried on, not when any criminality is only incidental, collateral to, or remote from the activity. Applying that to the facts of this case, none of the offences alleged by the Appellants are integral to Ahava's activities. |
