Property should always be in your name – if it is not, then it is not yours. You should not be holding any property in others’ names. If somebody were to grab the property, then it would be a very serious situation for you as the property owner. To prove that a particular property has to be transferred in your name, you need to give the death certificate of the previous owner. If somebody were to grab hold of your property or illegally occupy it, the process you follow at that time for transfer would take a lot of time and by then; the other person would have probably sold off your property! She also cautions about abandoning your property. Never abandon any property that belongs to you – instead, be alert and get your property transferred in your name. The way to go about it is to get a Transfer deed made after the death of the previous owner. Inheritance through a Will document or the law of natural succession in the absence of Will is two basic ways that transfer takes place. In case the person is alive then a Gift Deed is a document that is required. It is vital that you get all titles, revenue records and mutations in your name. None of these procedures, however, can be lawfully valid till a gift deed is registered. Registration involves payment of stamp duty and other registration costs.
