Dukes | 564 U.S. 338 (2011) The class-action lawsuit is an effective tool to litigate the rights of numerous plaintiffs. But these plaintiffs are bound by a class-action judgment only if their claims are similar. The United States Supreme Court in Walmart Stores, Incorporated versus Dukes examined just how similar those claims must be. Betty Dukes, Christine Kwapnoski, and Edith Arana, all current or former Wal-Mart Stores employees, sued the company, claiming that its corporate culture illegally discriminated against women regarding pay and promotions. The plaintiffs sought to certify a class of one and a half million current and former female Wal-Mart employees. They also sought monetary damages including back pay and injunctive relief. The federal district court certified the proposed class, and Wal-Mart Stores appealed to the Ninth Circuit of Appeals. An en banc divided court affirmed the class certification.
