| Video Discription | Hello Teamsters Local 767, this video is a crash course on the Weingarten Rights. As union members you have the right to union representation if you are called to a meeting with management that could lead to discipline. The Supreme Court case of National Labor Relations Board v. Weingarten, decided in 1975, established this basic entitlement and the procedures for when and how union reps may participate in interviews. Step 1. Make a clear request for union representation, You can just pull out your orange card and read it verbatim. You cannot be punished by management for requesting union representation and Managers do not have to inform their employees of their rights! Step 2. Your manager has three choices on how to proceed. 1. Grant your request, and wait for the shop steward before conducting the interview 2. End the interview 3. Ask you if you want to proceed without union representation. NO! It is against Federal Law for management to deny an employee’s request for a steward and in this case, the employee may respectfully refuse to answer managements questions until representation arrives. Your union representation has the right to know what the meeting is about beforehand, council you before and during the interview as well as help you ask clarifying questions during the interview.
