But when it does, it can get ugly. If the judge declares a mistrial, it must have been something that inflamed the court that requires the jury be dismissed from the case. In all likelihood, if the judge declares a mistrial because of something that an attorney did, you can bet that the attorney will get an earful and a significant admonishment from the judge. A mistrial means that all the time, effort and energy by the attorneys, the litigants, the jury and the court have put into the case up till that point will have been wasted. It means that that jury must now be dismissed and the lawyers must now go and pick a brand-new jury and start the case over from scratch.
