| Video Discription | Because Social Security is so backlogged with its disability claim evaluation process, many truly disabled claimants try to return to work even for a short period of time because they need to survive. As I discuss in this video, attempting to return to work can damage your pending disability case if you don’t know the rules. If you try to return to work and your earnings are below “SGA” (substantial gainful activity) levels, Social Security will not count your work efforts as being successful. In 2018, any month where your gross earnings are $1,180 per month or higher, that month is considered a successful work attempt month. Gross earnings of less than $1,180 per month (in 2018) are not SGA months and would be considered as part time work by Social Security. In theory, therefore, you could apply for benefits, and work continuously for the two to three years when your case is pending at less than SGA level. Note that the #SGA figure changes every year - so look at https://www.ssa.gov/oact/cola/sga.html for current figures. Unfortunately, however, my experience has been that on-going part time work will damage your case - see https://youtu.be/orenDPq6GIU. If your gross earnings are greater than SGA, Social Security will consider that month a successful work attempt. Per Social Security’s Program Operations Manual System (POMS), if your SGA level work continues for less than 6 months, that work effort would be considered as an “unsuccessful work attempt” or #UWA. These definitions become cloudier if you work at SGA level for several months, then stop for a brief period of time, or if you are laid off, or if your work becomes less than SGA. Social Security will look carefully at any work attempts to protect against people gaming the system. A good rule of thumb to keep in mind is that Social Security views disability in black and white terms - either you are disabled or you are not. If you try to work, that work effort may damage your case, or it could help your case by showing that you are genuinely trying to remain employed.
