Freedom From Religion Foundation | 551 U.S. 587 (2007) Generally, a taxpayer, by that status alone, doesn’t have standing to challenge the constitutionality of a statute or government act, absent very narrow exceptions. In the 2007 case Hein versus Freedom from Religion Foundation, Incorporated, the United States Supreme Court considered whether a corporation opposed to government endorsement of religion had standing to challenge expenditures made by the executive branch for religious programs. In 2001, George W. Bush, then president of the United States, issued an executive order creating the White House Office of Faith-Based and Community Initiatives. The new office protected the rights of private and charitable groups, including religious groups, by allowing them to compete on a level playing field with other organizations when seeking federal financial support. The only caveat was that groups couldn’t use the support for inherently religious activities. In addition, by separate executive order, the president created Executive Department Centers for Faith-Based and Community Initiatives to carry out the new office’s goals. Congress never passed a law appropriating taxpayer money for the activities of the centers, and the centers were instead funded entirely through general executive branch appropriations. Subsequently, Freedom from Religion Foundation, whom we’ll refer to as FFRF, sued Jay Hein, a director of the office, in federal district court for violating the First Amendment’s Establishment Clause. Specifically, FFRF argued that the office inappropriately used federal taxpayer money to support faith-based programs, that the president used religious imagery in speeches and praised faith-based programs, and that it was entitled to relief as a taxpayer. In response, Hein moved to dismiss the action for lack of standing, which the court granted. FFRF appealed to the Seventh Circuit, which reversed, concluding that the program constituted an inappropriate use of taxpayer money. The United States Supreme Court granted cert.
