In American Legion versus American Humanist Association, a cross memorializing fallen veterans has stood since the Nineteen Twenties. Now some claim it violates the Establishment Clause because it’s on public land. Following World War One, residents of Prince George’s County, Maryland, erected the Bladensburg Peace Cross as a memorial to forty-nine local fallen soldiers. The residents’ precise motivations for selecting a cross aren’t known, but after the war, crosses were used nationwide as a symbol commemorating the soldiers’ sacrifices. For many years, the American Legion used the Bladensburg Cross site to host patriotic events honoring veterans. By the Nineteen Sixties, the area had developed into a busy intersection, so the cross was transferred to a public-park planning commission. The commission began maintaining the cross with public funds. The American Legion reserved the right to continue its ceremonies at the site. In Twenty Fourteen, members of the American Humanist Association sued the commission, claiming that observing a cross on public land caused them offense and violated the Establishment Clause. The association sought removal of the cross or removal of the arms to form a nonreligious slab. The American Legion intervened to defend the cross. The district court granted summary judgment to the commission and the American Legion. The Fourth Circuit reversed. The Supreme Court granted cert. Want more details on this case?
